My “To Sydney University” Rant

It is amazing to me the number of people who waste their virtual breath on posting their perception of a warning in their profiles - simply amazing.

Apparently, at some point in the past, our community was informed that some of the information from this site was being used in a study, again apparently by Sydney University. It was also apparent that other sites, such as Passion.com were using information from our community. The less well informed became enraged and made a public outcry by putting a notice in their profile similar to the one below.

Sydney University and all other institutions using this or any Passion.com site or its associated sites for projects - You do not have permission from me to use any of my profile or pictures in any form or forum both current and future. If you have or do, it will be considered a violation of my privacy and will be subject to legal action.

That ought to fix ‘em. Now they’ve been warned that you, the individual community member does not give permission to use your pictures or you’ll sick your lawyer on them.

There are also many profiles that add “Everyone, put this in your profile” – right.

This is so silly. And the number of people who claim to be educated and professional in the very same profile that they post this nonsense in is staggering. In the year and a half I’ve been on this site, I’ve ignored these stupid “no trespassing” signs, yet, in profile after profile, I see them. When I hover over a picture and the little summary comes up, I am forced to read this instead of what the profile is really about, requiring me to actually click on a profile to see what they’re about.

This action leads to many unwanted solicitations. I have been repeatedly contacted after clicking a profile so that I could actually read it instead of skipping over it, and, after a couple of e-mail exchanges, they say something like “well why did you look at our profile if you weren’t interested?” Uhm, maybe because who you are and what you’re looking for is obscured by this stupid warning to Sydney University.

So therein lies the basis for my rant. Whether you agree or not is of little consequence to me. Facts are facts and for the unenlightened, you might do well to consider the following…

1. It is not illegal for anyone to use any of the photos posted on this site for any purpose. Period. You have posted your picture in public. It is analogous to you being in the background of a news story on television. They don’t need your permission to run the story. And so it goes with posting your picture on the internet, here or anywhere else.

2. You agreed, when you accepted the Terms of Use Agreement that Passion.com and any other affiliated Friends Network sites could use your picture, profile, or any other information you posted in using the site.

3. Let’s pretend, for the sake of argument, that Sydney University violated some law by using your profile or picture. They do not claim it is their art, and are not selling it for a profit thus, there is no copyright infringement. Further, since they are not using your likeness to turn a profit, there are no damages that can be awarded. The absolute WORST thing that could happen to them is to receive a “cease and desist” letter from an attorney – any attempt at recovering damages would be futile, and thus, no attorney would sue them.

4. Let’s further pretend, that you object to your photos being used by other sites, and you have been told that this is a serious legal violation (it isn’t, but go with me here). So what you would have to do, with a corporate entity, is identify yourself, and ultimately, identify yourself to the courts, which would make it a public record, thereby obviating any anonymity claims. If it wasn’t a face photo, you would have to prove that it was your picture that they were using. Now exactly how are you going to do that?

5. You agreed in the terms of use that "Your profile (and the contents thereof) may be searchable by third-party publicly available search engines."

It just seems like a silly waste of space, and frankly, is non sequitur.

....Love it when you use my nickname like that, but prefer if you don't use it in a sentence that contains "silly waste of space" as well.......

Captiv8us makes an exceptional point about the urban legend of Sydney University.

I think it's fair to say that some people, google their profile name and are (stupidly) surprised to see that their profile names comes up in places they've never been. They are truly perplexed as to how that could happen, then they assume that someone is using their profile and/or pictures. It's like when the rooster crows the sun comes up, so the rooster must be making the sun come up. Don't they realize that this is exactly what search engines are designed to do?

And what exactly IS the problem if someone used your profile pictures for part of a study?

Aside from the point about the expense and hassle involved, the reality is when you "sue", the first thing you have to do is PROVE that those pictures and profile belong to you. Even assuming you could do that, do you want to?

So you are going to create a public record showing that your dirty pictures and swinger lifestyle was used by someone else? If you have no problem with a public record, what the hell are you suing for anyway?

As far as judgements go, what are the damages? Can you prove that this has somehow affected your life and cost you opportunity? No.

So as Captiv8us implies, the whole point of this web site is to advertise your availability and desires. It seems rather silly to want to advertise, then become upset when it's advertised...

And let's not forget the main point - you agreed to have your profile show up on other web sites when you signed up. You have no legal leg to stand on.
